Couples whose marriage are less than 2 years old, at the time they applied for the alien spouse’s adjustment of status (Green Card), MUST file a petition to USCIS to upgrade the spouse’s green card from a “conditional” permanent residency to non-conditional.

Basically this is THE last checkpoint for Immigration to catch fraud. Immigration wants to verify that the couple is genuine, and that the marriage was not a sham.

2019 Costs to Remove Conditions on Permanent Residency

If your spouse was granted Permanent Residence to the USA, because of her or his marriage to you, a US Citizen, and your marriage was less than two years old at the time of applying, then the Green Card that was issued was limited, and marked to expire in two years..

This means the permanent residency granted was only conditional, only good for two years. This is to protect the USA from sham marriage fraud. The expectation is, that if there was no fraud you and your spouse would still be married and a genuine couple, and that your relationship has now passed “the test of time”

 

Near the end of the 2 years. the couple needs return to USCIS and and once again, demonstrate their marriage is bona fide.
