K-2 Child Aging Out: How to Request an Expedite for a Fiancé Visa
If your fiancé’s child is close to turning 21 while the K-1 and K-2 visas are still pending, time matters. A K-2 child may need expedited handling so the visa can be issued and used before the child ages out.

Expedite Request before Fiancee’s K-2 Child Ages Out
What to do when the child of your fiancee is about to turn 21 and their K1 and K2 visas are still in process and not yet approved?
The child of your fiancee is eligible to be granted and use a K2 Fiancee Dependent visa up to the eve of his or her twenty first birthday.
So you apply for your fiance and child before the child turns 21, the process takes place, the visa is issued and the child has up until midnight the eve of his or her birthday to board the flight to the USA.
One day late and the child can not come to the USA, at least not on a K2 visa.
Under normal circumstances the fiance visa takes under a year, and the couple that apply well before the child is 20 usually have no problem in getting parent and child’s visas on time without fuss.
However, under Covid there have been many delays, USCIS is performing much slower than pre-covid normal, and many consulates due to local quarantines in the countries where they are located due to closures and partial reopenings have added many months, and in some cases like the Philippines, years of delay before visas can be issued.
In this case, if your application has been properly filed, if it is getting close to the time it looks likely that the child will “age out”, US immigration does look favorably on requests to expedite.
During processing your K1 and K2 case will be either at USCIS, the National Visa Center, or the destination consulate. When it looks like the case will be approved too late, the sponsor directly contacts the processing location where the case is, explains the situation and makes the request.
On a successful request the case is forwarded immediately to the consulate and usually the consulate makes special accommodations to speed up the interview date and visa issuance.

Why a K-2 Child Aging Out Is Urgent
A K-2 visa is for the eligible child of a K-1 fiancé visa applicant. The problem is that the child must still qualify by age when the visa is issued and used. If the child turns 21 before traveling, the child may lose the ability to enter the United States on a K-2 visa.
That is why families with a child approaching age 21 must watch the timeline carefully. A case that would normally be routine can become urgent if USCIS, the National Visa Center, or the U.S. consulate is moving too slowly.
The Basic Rule: The Child Must Travel Before Turning 21
If your fiancé’s child is still eligible for a K-2 visa, the child may be issued and use the visa before the child’s 21st birthday. Practically speaking, this means the child must be able to complete the visa process, receive the visa, and travel to the United States before aging out.
One day can matter. If the child misses the deadline, the K-2 path may no longer be available.
When an Expedite Request May Be Appropriate
An expedite request may be appropriate when the K-1/K-2 case was properly filed but delays now create a serious risk that the child will turn 21 before the visa can be issued and used.
This is different from simply wanting the case to move faster. The reason for the expedite is the risk of permanent harm: the child may lose eligibility for the K-2 visa because of age.
Where to Send the Expedite Request
Where you make the request depends on where the case is at the time the age-out risk becomes urgent.
If the Case Is at USCIS
The U.S. sponsor contacts USCIS and explains that the K-2 child is approaching age 21 and may lose eligibility if the petition is not handled quickly.
If the Case Is at NVC
The sponsor contacts the National Visa Center and asks that the case be moved forward urgently because the K-2 child is close to aging out.
If the Case Is at the Consulate
The sponsor or applicant contacts the U.S. consulate and requests special accommodation for interview scheduling and visa issuance before the child turns 21.
What to Include in the Expedite Request
The request should be clear, direct, and supported by documentation. Explain that the child is included as a K-2 dependent, state the child’s date of birth, identify the current case location, and explain why ordinary processing may cause the child to age out.
- Case receipt number or case number
- Petitioner and beneficiary names
- K-2 child’s full name and date of birth
- Evidence of the child’s age, such as birth certificate or passport biographic page
- A short explanation of why expedited handling is needed
- A request for immediate forwarding, interview scheduling, or visa issuance, depending on where the case is located
What Happens If the Request Is Successful
If the expedite request is approved, the case may be moved forward more quickly. USCIS may review the petition sooner, NVC may forward the case to the consulate more quickly, or the consulate may make special accommodations for the interview and visa issuance.
There is no guarantee, but age-out risk is one of the situations where immigration agencies may take the request seriously because the child could otherwise lose the K-2 visa path entirely.
Do Not Wait Until the Last Minute
If your fiancé’s child is already 20, or close to 21, you should pay close attention to the timeline from the beginning. Waiting too long to raise the age-out issue can leave very little time for USCIS, NVC, the consulate, medical exam scheduling, interview scheduling, visa printing, and travel.
