Fiancee Visa (K1)The Fiancee visa is available for an American Citizen's fiance(e) to travel to the USA, for the purpose of marrying the citizen. Upon entry, the fiance(e) has 90 days to marry or leave. The couple must have had a face-to-face meeting within the past 24 months, both be "free to marry", and have a 'bone fide' relationship. Spousal Visa (CR1)The Spousal visa is available for an American Citizen or Legal Permanent Resident's spouse to enter the USA, to join her spouse. The couple must be "married", and have a "bone fide" relationship. The sponsor is a US Citizen or Legal Permanent Resident, and earns annual income of 125% or more of the national poverty level for his household size. Adjustment of StatusAfter a foreign born fiance(e) enters the USA on a fiancee visa and marries the US sponsor. The newly wed can apply for Adjustment of Status. This is permission to remain permanently as a legal resident of the USA. Removal of Conditions
When a
foreign born spouse is granted Permanent Residency, based on marriage
to a US Citizen or Resident, that is under two years
old, the green card issued is only valid for two years. Prior to the expiry of the green card,
the couple must apply for a 'Permanent" green card. |
